Denied Claims

Insurance companies that refuse to pay legitimate claims after an accident, injury, or property loss.

You paid your insurance premiums for years, expecting your insurer to be there when something went wrong. Then a denial letter arrives — for reasons that don’t make sense or seem to contradict the policy you bought. Denied claims are one of the most common ways insurance companies try to keep money that should be paid to policyholders. At Maples, Connick & Brendel, we push back hard.

Common Reasons Insurers Deny Claims

Some denials are legitimate. Many aren’t. The denials we challenge most often involve:

  • Claims of “pre-existing conditions” or prior damage that don’t match the facts
  • Allegations of “misrepresentation” on the original application
  • Disputes over whether the policy covers the type of loss
  • Late notice arguments when the policyholder did notify in time
  • Policy exclusions stretched far beyond their plain language
  • Demands for unnecessary documentation as a delay tactic
  • Claims that the loss didn’t reach the deductible

What to Do After a Denial

Don’t accept the first “no” as the final answer. Insurance policies are contracts, and the company is bound by what the policy actually says — not what the adjuster claims. Before responding to a denial, save every piece of correspondence, take pictures of the damage or injury, and keep a written log of every phone call. Then have an attorney review the denial letter and the full policy.

Types of Denied Claims We Handle

We represent policyholders on a wide range of denied claims, including auto and uninsured motorist (UM/UIM) claims, homeowners and property damage claims, hurricane and storm claims, health insurance claims, life insurance claims, and disability insurance claims. Each type has its own deadlines and procedural rules, and missing one can permanently affect your case.
